Small Claims Court of Ontario is a branch of the Ontario courts where individuals are able to resolve disputes of $25,000 or less amongst each other. It is a fast and inexpensive way of resolving legal issues in comparison to filing a claim at the Superior Court. Plaintiffs and defendants

The person who starts the lawsuit is called the plaintiff. The defendant is the person who is being sued. If there is more than one defendant, the people being sued are called co-defendants.

Types of cases and time limits for starting a lawsuit If someone has violated your legal rights and caused you to suffer a loss, you may be able to start a lawsuit against them. However, you must start your lawsuit within a certain time. The type of claim you are bringing will determine the time limit that applies. Before you spend the time and money to start a lawsuit you will need to know what the time limit is for your type of claim.

The defendant´s proper name

Before you start a lawsuit you will need to find out the proper legal name of the defendant. Who you name as a defendant will depend on whether your situation involves a person or a business. If you are going to sue a person, it is necessary to find out his or her legal name. A person´s legal name may appear on a lease, cheque, or another official document. If a defendant is known by more than one name, you should list all of their names. For example, you may refer to someone as “Robert Smith also known as Bob Smith.”
